TERMS AND CONDITIONS (“TERMS”)
Last updated 01.09.26 · Effective 01.09.26

1. Welcome

This website at rovebrand.ca (the "Website") is operated by ROVE LLC ("ROVE", "we", "us" or "our"). These Terms of Use (the "Terms") govern your access to and use of the Website.

By accessing or using the Website, you agree to be bound by these Terms. If you do not agree with any part of them, you may not access the Website.

2. Age of majority

The Website contains information about cannabis products and is intended solely for adults who have reached the legal age to purchase and possess cannabis in their province or territory of residence — 19 in most provinces and territories, 18 in Alberta, and 21 in Quebec.

You represent that you have reached that age. You must not access the Website if you have not. We may take reasonable steps to verify age, and may refuse or terminate access at any time.

You agree not to share, forward or reproduce content from the Website in any way that could make it accessible to a person below the legal age.

3. This website does not sell cannabis

The Website is informational only. No cannabis product is offered for sale through it, and no order, purchase or reservation can be placed on it.

In Canada, cannabis may lawfully be sold only through provincially and territorially authorized retailers. Availability, selection and the manner of purchase differ by province. Any reference on the Website to a product being available is a statement of availability at authorized retailers, and is not an offer to sell.

4. No medical or health advice

Nothing on the Website is medical advice or should be relied on as medical advice. Information about our products describes their characteristics and composition only. We make no claim that any product treats, prevents, cures or alleviates any condition or symptom.

Consult a qualified healthcare practitioner before using cannabis, particularly if you are pregnant or breastfeeding, are taking other medication, or have a health condition.

5. Ownership and restrictions on use

All content on the Website, including text, images, video, graphics, layout, design and software (the "Content"), is owned by or licensed to ROVE and is protected by Canadian and international copyright and other intellectual property laws.

You may view and download Content for your own personal, non-commercial use only. You may not modify, copy, reproduce, republish, post, transmit, distribute, display, perform, create derivative works from, transfer or sell any Content without our prior written consent.

6. Trademarks

ROVE, the ROVE logo, MiniBar, and the other names, marks and logos appearing on the Website are trademarks of ROVE or its licensors. Nothing on the Website grants any licence or right to use them. Third-party marks belong to their respective owners.

7. Links to third-party sites

The Website may link to sites and services we do not own or control. We are not responsible for their content, privacy practices or availability, and a link is not an endorsement. Review the terms and privacy policy of any third-party site you visit.

8. Prohibited uses

You agree not to use the Website:

  • for any unlawful purpose, or to solicit others to unlawful acts
  • to submit false or misleading information, including about your age
  • to harass, abuse, defame or discriminate against any person or group
  • to upload or transmit viruses or any other malicious code
  • to collect or track the personal information of others
  • to scrape, spider, crawl or otherwise harvest Content by automated means
  • to interfere with or circumvent any security feature of the Website, including any age-verification mechanism

We may terminate your access for breach of any of the above.

9. Errors, inaccuracies and omissions

Content on the Website may occasionally contain errors, inaccuracies or omissions, and may not be complete or current. Product information, including cannabinoid and terpene values, is indicative and may vary between production lots. The certificate of analysis for a given lot governs.

We may correct errors and change or update Content at any time without notice, and are under no obligation to do so except as required by law.

10. Disclaimer and limitation of liability

THE WEBSITE AND THE CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE.

TO THE FULLEST EXTENT PERMITTED BY LAW, ROVE AND ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES AND AGENTS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM YOUR ACCESS TO OR USE OF, OR INABILITY TO USE, THE WEBSITE.

[[ COUNSEL TO CONFIRM — several provinces limit the exclusion of implied warranties and of liability in consumer contracts, and Quebec restricts these clauses particularly. Confirm enforceability and adjust before publishing. ]]

11. Indemnification

You agree to indemnify and hold harmless ROVE and its affiliates from any claim or demand, including reasonable legal fees, arising out of your breach of these Terms or your violation of any law or of the rights of a third party.

12. Privacy

Our Privacy Policy explains how we collect, use, disclose and protect personal information, and forms part of these Terms.

13. Changes and termination

We may modify or replace these Terms at any time at our sole discretion. The effective date at the top of this page shows when they last changed. By continuing to use the Website after a change takes effect, you agree to the revised Terms.

We may suspend or terminate access to the Website, in whole or in part, at any time and without notice. Provisions that by their nature should survive termination will survive, including ownership, disclaimers, indemnity and limitation of liability.

14. Applicable law

These Terms are governed by the laws of the Province of [[ ONTARIO — CONFIRM: should match the licensee's jurisdiction ]] and the federal laws of Canada applicable in it, without regard to conflict-of-law principles. You submit to the exclusive jurisdiction of the courts of that province.

If you are a resident of Quebec, the mandatory provisions of Quebec law may apply to you regardless of the foregoing.

16. Entire agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and ROVE regarding the Website, and supersede any prior agreements. Our failure to enforce any provision is not a waiver of it. If any provision is held invalid or unenforceable, the remaining provisions remain in effect.
